Overview
Welcome to candle flames by Iztaccihuatl! We are a small, handcrafted soy candle business based in Mesa, Arizona. Throughout these Terms, "we," "us," and "our" refer to candle flames by Iztaccihuatl. Our store is powered by Shopify.
By visiting or purchasing from our store, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our store.
Section 1 — Who Can Use Our Store
By using our store, you confirm that you are at least the age of majority in your state of residence. You are responsible for ensuring that any minor dependents using your devices or account have your permission to do so.
You may be asked to provide your name, email, shipping address, and payment information to complete a purchase. You agree that all information you provide is accurate and complete.
You are solely responsible for the security of your account. Accounts may not be transferred or shared.
Section 2 — Our Products
All of our candles are handcrafted in small batches using soy wax, cotton wicks, and fragrance oils. Because they are made by hand, there may be minor natural variations in appearance, color, scent throw, or texture between batches. These variations are a characteristic of handmade goods and are not considered defects.
We make every effort to accurately represent our products through photos and descriptions, but colors may appear differently depending on your screen settings. We do not warrant that product appearance will exactly match what is shown on your device.
We reserve the right to discontinue any product, adjust descriptions, or limit quantities at any time without notice.
Section 3 — Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is not confirmed until you receive an order confirmation email.
Because our candles are made in small batches, we may occasionally need to cancel an order due to inventory or production limitations. If this happens, we will notify you promptly and issue a full refund.
Please review your order carefully before submitting. Due to the handcrafted nature of our products, we may not be able to accommodate cancellation requests once production has begun.
All purchases are subject to our Refund & Return Policy. You represent that your purchases are for personal or household use only and not for commercial resale.
Section 4 — Pricing & Payment
Prices are subject to change without notice. The price charged will be the price shown at the time your order is placed, as confirmed in your order confirmation email. Prices do not include applicable taxes or shipping unless stated otherwise.
We may offer promotions or discounts from time to time. Promotional terms govern in the event of any conflict with these Terms.
You agree to provide accurate and complete payment information. You represent that you are authorized to use the payment method provided and that charges will be honored by your financial institution.
Section 5 — Shipping & Delivery
We ship domestically via USPS. Orders are processed within 2–3 business days. Delivery estimates are provided by the carrier and are not guaranteed.
Once your order is handed off to USPS, title and risk of loss passes to you. We are not responsible for delays caused by the carrier, weather, or other events outside our control.
If your order arrives damaged, please refer to our Refund & Return Policy and contact us within 48 hours of delivery.
Section 6 — Intellectual Property
All content on our store — including our name, logo, product photos, descriptions, and branding — is the property of candle flames by Iztaccihuatl and is protected by applicable copyright and intellectual property laws.
You may not reproduce, copy, distribute, or use any of our content for commercial purposes without our prior written consent. Unauthorized use may violate federal and state law.
Section 7 — Third-Party Tools
Our store may provide access to third-party tools or integrations (such as payment processors or shipping services). These are provided "as is" and we make no warranties regarding their performance. Your use of any third-party tools is at your own discretion and subject to their respective terms.
Section 8 — Third-Party Links
Our store may contain links to third-party websites or services (such as social media platforms or shipping carriers). We are not responsible for the content, accuracy, or practices of any third-party sites. If you choose to leave our store to visit a third-party site, you do so at your own risk.
Any complaints or concerns about third-party products or services should be directed to that third party directly.
Section 9 — Our Relationship with Shopify
Our store is built and hosted on Shopify, which enables us to provide you with a secure shopping experience. However, all sales are made directly between you and candle flames by Iztaccihuatl. Shopify is not a party to any transaction and is not responsible for any products, services, or disputes arising from your purchases with us. By using our store, you release Shopify and its affiliates from any claims related to your transactions with candle flames by Iztaccihuatl.
Section 10 — Privacy
Your personal information is handled in accordance with our Privacy Policy. By using our store, you confirm you have read and understood it. Because our store is hosted by Shopify, certain information is also subject to Shopify's Privacy Policy (shopify.com/legal/privacy).
Section 11 — Reviews & Feedback
We love hearing from our customers! If you submit a review, comment, photo, or any other feedback about our candles or your experience, you grant candle flames by Iztaccihuatl a perpetual, royalty-free license to use, share, and display that content to operate and promote our store.
By submitting feedback you confirm that you own the content or have the right to share it, your feedback is honest and accurate, and your feedback does not infringe on any third party's rights.
We reserve the right to remove any feedback that is unlawful, offensive, or otherwise inappropriate at our sole discretion. We are not obligated to respond to, compensate for, or keep confidential any feedback submitted.
Section 12 — Errors & Inaccuracies
We do our best to ensure all product descriptions, pricing, and availability information on our store is accurate. However, occasional errors may occur. We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice — including after an order has been placed. If a pricing error affects your order, we will contact you before proceeding.
Section 13 — Acceptable Use
You may only use our store for lawful purposes. You agree not to use our store for any illegal or harmful purpose, infringe on our intellectual property or that of others, harass or harm any person, submit false or misleading information, send spam or unsolicited messages, impersonate any person or entity, upload viruses or malicious code, scrape or resell any part of our store, collect other users' personal information, or use automated tools or AI agents to access our store without authorization.
We reserve the right to suspend or terminate your access at any time if we determine you have violated these Terms.
Section 14 — Automated Access & AI Agents
Any software, bot, or AI agent accessing our store on your behalf must identify itself clearly in all requests and may not impersonate human behavior, bypass security measures, or circumvent CAPTCHAs. We reserve the right to block or limit automated access at any time.
Section 15 — Termination
We may terminate your access to our store at any time, for any reason, without notice. You remain responsible for any outstanding amounts owed up to the date of termination. Sections covering Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.
Section 16 — Disclaimer of Warranties
Our store and products are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that our store will be uninterrupted, error-free, or completely secure.
While we take great care in crafting our candles, we make no warranty that any product will meet your specific expectations beyond what is described in our product listings. Some jurisdictions do not allow the exclusion of implied warranties, so this disclaimer may not fully apply to you.
Section 17 — Limitation of Liability
To the fullest extent permitted by law, candle flames by Iztaccihuatl and its owner, employees, and service providers shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of our store or products — including lost profits, data loss, or damages resulting from improper use of our candles.
Our total liability to you for any claim arising from a purchase shall not exceed the amount you paid for the product in question.
Section 18 — Indemnification
You agree to defend, indemnify, and hold harmless candle flames by Iztaccihuatl, its owner, and Shopify from any claims, losses, or damages — including reasonable legal fees — arising from your breach of these Terms, your violation of any law, or your misuse of our store or products.
We will notify you of any such claim promptly. We may manage the defense of any claim at your expense but will not settle any claim that imposes non-monetary obligations on you without your consent.
Section 19 — Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
Section 20 — Entire Agreement
These Terms, together with our Privacy Policy and any other policies posted on our store, constitute the entire agreement between you and candle flames by Iztaccihuatl. Our failure to enforce any right or provision does not constitute a waiver of that right.
Section 21 — Assignment
You may not transfer or assign your rights under these Terms without our prior written consent. We may transfer or assign our rights at any time without notice to you.
Section 22 — Governing Law
These Terms are governed by the laws of the State of Arizona, United States. You consent to the jurisdiction of the courts located in Arizona for any disputes arising from your use of our store or products.
